Terms of service

These Terms govern your use of checkoutworks.dev and services provided by CheckoutWorks, a business operated by GALE INNOVATIONS LLC. By purchasing or using a service, you agree to these Terms.
Services and Scope
CheckoutWorks provides Shopify development, troubleshooting, configuration, consulting, and related professional services. The applicable service page, order confirmation, proposal, or written scope defines what is included. A specific written agreement controls if it conflicts with these general Terms.
CheckoutWorks is an independent service provider and is not Shopify. We may refuse work that is unlawful, unsafe, unauthorized, technically impractical, or outside the purchased scope.
Your Responsibilities
You must provide accurate requirements, timely access, content, feedback, and approvals; maintain appropriate backups; and have the right to use all materials you provide. Delays in providing these items may delay delivery.
You authorize us to access and modify only the stores, accounts, files, and systems reasonably required for the agreed service. You remain responsible for account ownership, permissions, backups, and removing our access when it is no longer needed.
Delivery and Scope Changes
A service is delivered when we provide the agreed deliverable, complete the agreed implementation, complete a scheduled service, or notify you that the work is complete.
New features, additional work, changed preferences outside the agreed scope, and work caused by later third-party changes may require a new order, fee, or delivery date.
30-Day Satisfaction Guarantee
If you are not satisfied with delivered work, contact us within 30 calendar days after delivery. We will make reasonable revisions at no extra cost within the agreed scope. You must give us a reasonable opportunity to review the issue and make it right.
If you are still not satisfied after the revisions, or if we cannot reasonably resolve your concerns within the agreed scope, we will refund the CheckoutWorks service fee paid for the affected service. Full conditions are in our Return and Refund Policy.
Payments and Cancellations
Prices are shown at checkout or in the applicable written agreement. Taxes may be collected where required. Third-party products and services are not included unless expressly stated.
If you cancel before work begins, we will refund the CheckoutWorks service fee. If work has begun, we may retain a reasonable amount for completed work and authorized non-recoverable costs.
Intellectual Property and Confidentiality
You retain ownership of materials you provide. After full payment, you own project-specific deliverables created exclusively for you. Our pre-existing tools, reusable code, methods, templates, know-how, third-party materials, and open-source components remain ours or their respective owners. We grant you the rights needed to use them as part of the deliverable.
Each party will protect the other party’s non-public information and use it only for the business relationship. We will request permission before identifying you or displaying your work as a case study.
Third-Party Services
Our work may depend on Shopify, apps, themes, APIs, hosting, and other providers. We are not responsible for their outages, security incidents, policy changes, discontinued features, account decisions, or later modifications. We do not guarantee sales, conversion rates, rankings, approvals, or other business outcomes unless agreed in writing.
Acceptable Use
You may not use our website, services, or deliverables for unlawful activity, infringement, fraud, unauthorized access, malicious code, platform abuse, or harm to another person or system.
Warranties and Liability
We will perform services with reasonable care and skill. To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability for a service will not exceed the amount paid for that service. These limits do not apply where liability cannot legally be limited, including mandatory consumer rights.
Governing Law and Changes
These Terms are governed by Wyoming law, except where mandatory consumer law provides otherwise. The parties will first try in good faith to resolve disputes. We may update these Terms, but changes do not retroactively alter an accepted project scope unless agreed or required by law.
